Section 1: Acceptance of Terms
By accessing or using Eko ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you and LAB90 LLC, operating as Eko ("we," "us," or "our"). We encourage you to read them carefully before creating an account or using any features.
Section 2: Description of Service
Eko is an AI-powered page monitoring service that tracks publicly accessible webpages and delivers intelligent change summaries. The Service includes:
- Page tracking and change detection — automated monitoring of public webpages you specify, checking each page multiple times per day
- AI-generated summaries — plain-English explanations of what changed, why it matters, and suggested next steps, accompanied by confidence scores
- Notifications — email alerts for every meaningful change, optional daily digests, and instant SMS alerts for pages marked as Urgent
- Organization tools — folders, favorites, and tracking notes to manage your monitored pages
Eko monitors only publicly accessible webpages. We do not track pages behind authentication, and we do not collect or store personal information from monitored pages.
Section 3: User Accounts
3.1 Account Creation
To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the accuracy of your account details.
3.2 Credential Security
You are responsible for safeguarding your login credentials. Do not share your password or allow others to access your account. Notify us immediately at legal@eko.app if you suspect unauthorized access.
3.3 Account Responsibility
You are responsible for all activity that occurs under your account, whether or not you authorized it.
3.4 One Account Per User
Each account is intended for use by a single individual. Account sharing is not permitted. Team plans are available for organizations that need multiple users.
Section 4: Acceptable Use
You agree not to use the Service to:
- Track pages you are not authorized to access — the Service is designed for publicly accessible webpages only
- Violate any applicable law or regulation, including data protection, intellectual property, and anti-spam laws
- Infringe on the intellectual property rights of any third party
- Attempt unauthorized access to the Service, other user accounts, or any systems connected to the Service
- Disrupt or interfere with the Service, its infrastructure, or other users' access
- Conduct automated bulk operations against the Service, including scraping, automated account creation, or API abuse beyond documented rate limits
We reserve the right to suspend or terminate accounts that violate these terms.
Section 5: Subscription and Billing
5.1 Plans
Eko offers a Free plan and paid subscription plans (Base, Pro, and Team). Plan details, including page limits and features, are described on our pricing page.
5.2 Billing Cycle
Paid plans are billed monthly or annually, depending on your selection at the time of purchase. Charges are processed at the beginning of each billing cycle.
5.3 Upgrades and Downgrades
You may upgrade your plan at any time; changes take effect immediately. Downgrades take effect at the start of your next billing cycle.
5.4 Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing cycle. You will retain access to paid features until your billing period ends. No refunds are issued for partial billing periods.
5.5 Price Changes
We may change subscription prices with at least 30 days' notice. Price changes take effect at the start of your next billing cycle after the notice period.
Section 6: Intellectual Property
6.1 Our Rights
The Service, including its software, design, features, documentation, and branding, is owned by Eko and protected by applicable intellectual property laws. Nothing in these Terms transfers ownership of the Service to you.
6.2 Your Content
You retain ownership of any content you provide to the Service, including tracking notes, folder names, and account information. By using the Service, you grant Eko a limited, non-exclusive license to use this content solely for the purpose of operating and improving the Service.
6.3 AI-Generated Summaries
Change summaries generated by the Service are produced by AI analysis of publicly available webpage content. These summaries are intended to inform you about changes and drive you back to the original source — they are not a substitute for visiting the source page.
Section 7: Third-Party Content
The Service monitors publicly accessible third-party webpages. Eko does not control, endorse, or assume responsibility for the accuracy, completeness, or legality of any third-party content.
AI-generated summaries are based on automated analysis and may contain inaccuracies. Confidence scores are provided to help you assess the reliability of each summary. For important decisions, always verify changes by visiting the source page.
Section 8: Limitation of Liability
To the maximum extent permitted by law, Eko and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunity, arising from your use of or inability to use the Service.
Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid to Eko in the 12 months preceding the claim.
Section 9: Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The Service will be uninterrupted, error-free, or secure
- AI-generated summaries will be accurate or complete
- The Service will detect all changes to monitored pages
- Notifications will be delivered without delay
Section 10: Termination
10.1 Termination by You
You may delete your account at any time through your account settings. Upon deletion, your tracked pages, change history, and account data will be permanently removed.
10.2 Termination by Eko
We may suspend or terminate your account if you violate these Terms, engage in prohibited activity, or if required by law. We will make reasonable efforts to notify you before termination, except where prohibited by law or where immediate action is necessary to protect the Service.
10.3 Effect of Termination
Upon termination, your right to use the Service ceases immediately. Sections 6, 7, 8, 9, and 12 survive termination.
Section 11: Changes to Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email or through the Service at least 30 days before the changes take effect.
Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the Service and delete your account.
Section 12: Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Delaware. You consent to the personal jurisdiction of these courts.
