Terms of Service

eko.day is an AI-assisted call-answering and lead-capture service operated by LAB90 LLC for subscribed home-services businesses. The service answers inbound calls on behalf of those businesses and relays caller requests back to them. Access is provided to subscribing businesses and, where applicable, to callers who interact with those businesses through eko.day.

You may use eko.day only for lawful purposes and in accordance with these Terms. You agree not to misuse the service, circumvent any security or technical measures, submit false or misleading information, or use the service to transmit unlawful, harassing, or fraudulent communications. LAB90 reserves the right to modify, suspend, or discontinue the service at any time with or without notice.

eko.day offers an optional SMS notification channel that is separate from and not required for the voice receptionist service. If you opt in at the SMS opt-in page, you may receive service notifications, confirmations, and reminders from the participating business you contacted. Opting in (or not) has no effect on any call, service request, or outcome.

• Carriers are not liable for delayed or undelivered messages.
• Supported carriers include AT&T, Verizon, T-Mobile, and most other major U.S. carriers. Carrier participation may change without notice.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. LAB90 DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY INFORMATION PROVIDED THROUGH THE SERVICE IS ACCURATE OR COMPLETE.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LAB90 AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE. IN NO EVENT SHALL LAB90'S TOTAL LIABILITY TO YOU EXCEED fees paid by you to LAB90 in the twelve (12) months preceding the claim, or $50, whichever is greater.

These Terms are governed by and construed in accordance with the laws of the State of Georgia, USA, without regard to its conflict-of-law provisions. Any dispute arising under or related to these Terms shall be resolved exclusively in the state or federal courts located in Atlanta, Georgia. You consent to the personal and exclusive jurisdiction of those courts.
